This Participant Agreement (“Agreement”) sets forth the terms under which SOCO Pickleball United (“SPU,” “we,” or “our”) permits individuals to participate in recreational, instructional, and competitive pickleball-related programs (“Programs”). Programs may take place at facilities, courts, or venues owned or operated by third parties (“Locations”). By participating, I acknowledge that I have read, understand, and agree to this Agreement on behalf of myself and, if applicable, any minor participant for whom I am legally responsible. ________________________________________ Voluntary Participation and Activity Description I understand that the Programs may include instruction, drills, league play, tournaments, clinics, physical conditioning, and other athletic activities. I voluntarily choose to participate, recognizing that pickleball involves physical exertion and interaction with equipment, playing surfaces, and other participants. ________________________________________ Risks Associated with Participation I understand that participation in the Programs involves inherent and unpredictable risks, including but not limited to: •Contact with paddles, balls, nets, court surfaces, fences, walls, or other objects. •Equipment malfunction or improper installation or use. •Injuries such as strains, sprains, fractures, bruises, concussions, or other musculoskeletal or soft-tissue injuries. •Slips, falls, loss of balance, or collisions with participants or objects. •Dehydration, heat-related illness, fatigue, overexertion, or respiratory distress. •Exposure to weather conditions, allergens, airborne contaminants, or environmental hazards. •Exposure to communicable diseases or other public health risks. •Accidents while entering, exiting, or moving within Locations. •Delayed or limited access to medical assistance. •Actions or negligence of other participants or members of the public. •Loss, damage, or theft of personal property. This list is not exhaustive, and other risks may exist. ________________________________________ Assumption of Risk I knowingly and voluntarily assume all risks associated with participation in the Programs, whether known or unknown, foreseeable or unforeseeable. These risks may result in injury, illness, property loss, or, in rare cases, death. I understand that while SPU takes reasonable steps to promote safety, it cannot eliminate all risks, including those related to injury or illness. I confirm that I am physically and mentally able to participate and have no medical condition that would make participation unsafe. ________________________________________ Release, Waiver, and Indemnification To the fullest extent permitted by law, I agree on behalf of myself and any participating minors to the following: a. Release and Waiver I release SOCO Pickleball United and its owners, officers, employees, volunteers, contractors, and agents (“Released Parties”) from any and all claims or liabilities arising from or related to participation in the Programs. b. Indemnification I agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, or expenses, including reasonable attorneys’ fees, arising from my or my child’s participation. c. Scope of Release This release applies to claims resulting from the ordinary negligence of the Released Parties and does not apply to gross negligence, willful misconduct, or criminal acts. ________________________________________ Governing Law and Venue This Agreement is governed by the laws of the State of Colorado. Any legal action arising from this Agreement or participation in the Programs must be brought exclusively in the state courts of El Paso County, Colorado. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in effect, and the unenforceable provision shall be interpreted to best reflect the original intent while complying with applicable law.

SOCO Pickleball United has established the following policies to promote a safe, organized, and enjoyable environment. These policies apply to all participants and guests at all Locations, including courts, common areas, parking lots, and walkways. Participation in any Program constitutes agreement to comply with these policies. Failure to do so may result in suspension, termination of membership, or exclusion from Programs. SPU reserves the right to interpret and enforce these policies at its discretion, and all decisions are final. Policies may be updated at any time. ________________________________________ All participants and guests are expected to: •Act with integrity, sportsmanship, and respect. •Promote a welcoming and inclusive environment. •Prioritize safety for themselves and others. •Follow SPU policies, rules, and staff instructions. Participants must also: •Use respectful language; aggressive behavior, bullying, harassment, discrimination, or disruptive conduct will not be tolerated. •Adhere to official USA Pickleball Rules and accept decisions by staff, organizers, or referees without argument or retaliation. •Refrain from making any calls that would give your team an illegitimate advantage, such as making intentional incorrect line calls. •Respect facilities and equipment; comply with all facility regulations. •Wear appropriate attire, including shirt and court shoes; clothing with offensive or discriminatory language is prohibited. •Avoid use of alcohol*, tobacco, illegal substances, and personal music speakers. •Obtain prior approval before recording photos or videos for commercial or promotional purposes. •Ensure minors under age 13 are supervised by a parent or guardian. Concerns or violations should be reported to SPU staff. Reports will be handled discreetly, and disciplinary action will be determined by SPU leadership. *Alcohol may be consumed and/or advertised as being offered in select social events or special events that are held at indoor facilities that serve alcohol. Players should always follow the rules and guidelines of the facility where Programs are being hosted.

CLUB POLICIES

Membership Pricing and Payment Upon enrollment in a paid membership, the advertised monthly or annual fee will be charged to the provided credit card. Monthly memberships renew automatically each month on the day of the month that the membership is purchased. Members authorize SPU to charge the card on file for membership fees and Program registrations. SPU reserves the right to adjust fees at any time. ________________________________________ Membership Changes and Cancellation Guest memberships may be upgraded to paid memberships at any time. Paid memberships may only be changed or cancelled at the end of the designated term. All paid memberships are non-refundable. Memberships automatically renew unless cancelled at least 7 days before the renewal date. All paid memberships automatically expire and are cancelled on the designated end-of-season date for each year. Members must call or email SPU to cancel early. Upon cancellation, the account will revert to Guest status. ________________________________________ Drop-In Program Limits Guests are limited to book just 1 drop-in program (round robin, ladder, king of the court) every 7 days. Players with a paid membership can book up to 2 drop-in programs every 7 days. If a program is not full within 72 hours of the start time, then members may book an extra program (beyond the 2 max) if that event isn't full (guests may do so within 48 hours). Limits are subject to change depending on availability, demand, and number of members. ________________________________________ Event Cancellations Event and lesson reservations may be cancelled via phone, text, or the CourtReserve app. Cancellations for Drop-In Programs made at least 4 hours before the scheduled start time are eligible for a full refund in the form of account credit. Cancellations under 4 hours must be made by phone or text and are subject to receiving a partial credit at the discretion of SPU. No-shows will be charged at the applicable rate and will not receive a credit. After a player's first two no-shows, they will be issued a warning. After a third no-show, that player will be banned and will no longer be able to participate in any SPU events. Account credits can be used to book future Programs. Clinics, leagues, and tournaments are subject to having varying cancellation policies which will be listed in the event description of each Program. ________________________________________ Weather All outdoor Programs are subject to cancellation due to weather or other unforeseen circumstances. Registered participants will be notified by email and/or text message if a Program is cancelled. Decisions are typically made 1-2 hours before the start time; however, due to rapidly changing local conditions, cancellations may occur within one hour of start time or during the Program. Players will receive a full credit to their player account in the event of a cancellation before the Program begins. If a Program is cancelled after it has begun, participants will receive a prorated credit to their player account. Lessons, clinics, leagues, and tournaments are subject to being rescheduled; players would not receive a credit if the event is rescheduled. ________________________________________ Skill Level Categories Participants should register for Programs that reflect their true skill level. SPU reserves the right to reassign players to ensure balanced and appropriate competition. SPU uses DUPR to create organized play sessions for different skill levels. DUPR (Dynamic Universal Pickleball Rating) uses match results — including score differentials, opponent ratings, and match type — to calculate a player’s skill level on a dynamic scale from 2.000 to 8.000. A DUPR reliability score (0 to 100%) indicates the level of confidence in a player’s rating based on the quantity, recency, and consistency of recorded match results. Ratings update continuously as new matches are recorded, becoming more accurate as a player logs more results against a variety of opponents. If a participant has a DUPR with a sufficient reliability score (60% or higher), that rating will determine eligibility for a SPU Program. If a player does not have a DUPR with a high reliability score, then SPU staff have the authority to use their judgment for the appropriate level of play for those participants. Participants are encouraged to join our DUPR-rated Programs to maintain fair competition and an enjoyable experience for all players. Our Program Levels (with each DUPR range): •Beginner: 2.0 – 2.74 •Novice: 2.75 – 3.24 •Intermediate: 3.25 – 3.74 •Proficient: 3.75 – 4.24 •Advanced: 4.25+ These levels and/or ranges are subject to change and/or having additional levels added at any time.

PRIVACY POLICY

Information We Collect SPU may collect personal information including contact details, membership and registration information, emergency contacts, payment records (processed by third parties), website usage data, and photos or videos taken during Programs. Use of Information Information is used to administer Programs, process payments, communicate updates, improve services, ensure safety, and conduct permitted marketing activities. Photos and Media SPU may photograph or record Programs for promotional or educational purposes. Participants may opt out by providing written notice, though complete exclusion cannot be guaranteed. Information Sharing SPU does not sell personal information. Information may be shared with service providers, insurers, legal advisors, or as required by law. Data Security and Retention Reasonable safeguards are used to protect personal information, which is retained only as long as necessary. If a member wishes to have their information removed from the SPU CourtReserve system, they must make a request by emailing or calling – simply canceling their membership will not remove their data. Your Rights You may request access to, correction of, or deletion of personal information, or opt out of non-essential communications, subject to applicable law. Children’s Privacy Information about minors is collected only as necessary and with parental or guardian consent.
